In California, bonuses aren’t just festive — they’re legally complex. Why? Because California has some of the strictest wage and hour laws in the country, and holiday bonuses can impact your Regular Rate of Pay (RROP) for overtime calculations.

🎁 Discretionary vs. Non-Discretionary Bonuses

Here’s the key distinction:
  • Discretionary Bonus: A surprise gift, not tied to performance or predetermined criteria. These do not affect RROP.
  • Non-Discretionary Bonus: Based on meeting goals (like sales quotas or performance metrics). These must be included in RROP when calculating overtime.
Fail to include that bonus in your RROP? You could be facing penalties under California law — and possibly a PAGA claim.

Unlike many states, California requires:
  • Accurate RROP calculations for all overtime hours.
  • Inclusion of non-discretionary bonuses in those calculations.
